Terms and Conditions of the Service

I. General Definitions

• Terms and Conditions – these terms and conditions.

• Service – the online service “super-stars.pl”, available at https://super-stars.pl.

• Service Provider – the company “Elgra W.E. Kubik sp.j.” with its registered office at ul. Kępska 21, 45-129 Opole, NIP: 7540272177.

• Service User – any natural person who accesses the Service and uses the services provided by the Service Provider through the Service.

• Electronic Communication – communication between the parties via electronic mail (email) and contact forms available on the website.

II. General Provisions

• These Terms and Conditions define the rules of operation and use of the Service and set out the rights and obligations of Service Users and the Service Provider related to the use of the Service.

• The Service Provider provides free tools in the form of the Service that allow Users access to content in the form of posts, articles, audiovisual materials, or web applications and electronic forms.

• Any content, articles, and information of an advisory nature published on the Service are general in nature and not directed at specific Users. The Service Provider is not liable for their use by Users.

• The User takes full responsibility for how they use the materials made available within the Service, including compliance with applicable laws.

• The Service Provider provides no warranty regarding the suitability of materials published on the Service.

• The Service Provider is not liable for any damages incurred by Users or third parties resulting from use of the Service. All risk associated with the use of the Service, especially the use and application of information published within it, lies with the User.

III. Terms of Use of the Service

• Use of the Service by any User is free of charge and voluntary.

• Users are required to read the Terms and Conditions and other documents forming their integral parts and must accept them in full to continue using the Service.

• Users may not use any personal data obtained via the Service for marketing purposes.

• Technical requirements for using the Service:

  • a device with a display capable of rendering websites,

  • internet connection,

  • any internet browser that follows W3C Consortium standards and supports HTML5,

  • JavaScript enabled,

  • Cookies enabled.

• For security of the Service Provider, Users, and other Users, all Users should adhere to generally accepted online safety practices.

• The following actions are prohibited, whether performed manually or using software, without prior written consent:

  • decompiling or analyzing the source code,

  • causing excessive server load,

  • attempting to discover vulnerabilities in the Service or server configuration,

  • uploading or injecting code, scripts, or software that may harm the Service, other Users, or the Provider,

  • uploading or injecting tracking or data-stealing software,

  • any actions intended to damage, disable, or disrupt the Service.

• In the event of a cybersecurity incident or potential GDPR breach, Users should first report it to the Service Provider for prompt resolution and mitigation.

IV. Registration Terms and Conditions

• Users can access the Service without registration.

• Users must register and have an account to use additional services available only to logged-in Users.

• Registration is voluntary and free of charge.

• Each User may only have one account.

• Technical requirements for account registration:

  • possession of a personal email account.

• By registering, Users agree to the processing of their personal data entered during registration and any future modifications or deletion.

• The Service Provider reserves the right to suspend or delete User accounts at its discretion, especially in case of violation of the Terms, laws, social norms, harm to the Provider, other Users, or the Provider’s justified interests or partners.

• All services in the Service may be altered, added, removed, suspended, or limited by the Provider without the right of objection from Users.

• Additional account security rules:

  • Users must not share login credentials with third parties.

  • The Provider will never ask for a User’s password.

• Account deletion:

  • Each User has the option to delete their account independently.

  • This can be done via the User panel after logging in.

  • Deletion removes all identifying data and anonymizes the username and email.

V. Newsletter Service Terms

• Users can use the Service without subscribing to the Newsletter.

• Subscribing to the Newsletter is voluntary and free of charge.

• Technical requirements for the Newsletter service:

  • possession of a personal email account.

• Newsletter subscription terms:

  • providing an email address via form,

  • verifying the email address via a link sent,

  • consenting to receive email notifications.

• Scope of Newsletter:

  • updates on news, posts, contests, and promotional campaigns related to the Service,

  • promotional content from Service partners (Marketing messages).

• Unsubscribing:

  • Users can unsubscribe via a link in each email,

  • This removes the email from the Provider’s database.

VI. Communication and Other Services

• The Service offers tools allowing Users to interact through:

  • Contact form,

  • Commenting on posts and articles.

• Contact options include:

  • Email address,

  • Contact phone number.

• Personal data shared during contact is processed in accordance with the “Privacy Policy“, which is an integral part of the Terms.

• User content submission rules:

  • No offensive or defamatory content toward the Provider, other Users, or third parties.

  • No copyrighted materials unless the User holds a valid license or rights.

  • No vulgar, pornographic, erotic, or illegal content or links to such content.

  • No software/scripts that overload the server or pose a security threat.

  • No marketing or advertising content promoting external commercial sites, products, or services.

VII. Collection of User Data
To ensure proper service delivery, legal security, and compliance with applicable laws, the Service collects and processes certain User data.

Cookies are used to store anonymous information.

    • Gender,

    • Interests.

These data are collected via Google Analytics and remain anonymous.

• Data collected during registration:

  • Username, full name, email address.

  • A User ID tied to the account may be stored in cookies.

• Data collected when subscribing to the newsletter:

  • Email address.

VIII. Copyright

• The Service and its copyrights belong to the Provider.

• Some content is protected by third-party copyrights and used under license or free license.

• According to the Act on Copyright (Feb 4, 1994), it is prohibited to copy, reproduce, or store any materials (articles, photos, videos, etc.) from the Service without written or electronically confirmed consent from the rightful owner, except indexing by search engines like Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook, or LinkedIn.

• Simple press information (facts without commentary) are not protected. Use of such info is allowed, but copying entire or partial articles is not, unless otherwise noted.

IX. Changes to the Terms and Conditions

• The Provider may amend the Terms at any time without justification.

• Registered Users will be informed via email about changes.

• For unregistered Users, new Terms apply immediately after publication.

• For registered Users, new Terms apply after a 7-day transition period.

• Continuing to use the Service after a change implies full acceptance of the new Terms.

X. Final Provisions

• The Provider is not responsible, to the extent allowed by law, for content published by Users regarding truthfulness, accuracy, authenticity, or legal defects.

• The Provider will strive for uninterrupted service but is not liable for disruptions due to force majeure, User misconduct, third parties, or bots.

• The Provider may change any content on the Service at any time without prior notice.

• The Provider may temporarily or permanently disable the Service for upgrades, maintenance, or expansion without notice.

• The Provider may assign its rights and obligations related to the Service without User consent or objection.
